**1) Scope**
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Seiha Heng, operating under "KATAAB" (hereinafter referred to as "Seller"), apply to all contracts for the supply of goods that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller regarding the goods presented by the Seller in their online shop. The inclusion of the Customer’s own terms is hereby excluded, unless otherwise agreed upon.
1.2 These GTC also apply to contracts for the provision of vouchers, unless otherwise stipulated.
1.3 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes predominantly outside their commercial or independent professional activities.
1.4 An entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership, acting in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

**2) Conclusion of Contract**
2.1 The product descriptions in the Seller’s online shop do not represent binding offers from the Seller but serve to submit a binding offer by the Customer.
2.2 The Customer may submit their offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, by clicking the button that concludes the order process, the Customer submits a legally binding offer to purchase the goods in the shopping cart. The Customer may also submit the offer to the Seller by telephone, email, postal service, or online contact form.
2.3 The Seller may accept the Customer's offer within five days:
- by sending a written order confirmation or an order confirmation in text form (fax or email), with receipt by the Customer being decisive;
- by delivering the ordered goods to the Customer, with receipt by the Customer being decisive;
- or by requesting payment from the Customer after the Customer has placed the order.
If several of these alternatives apply, the contract is concluded at the moment one of the alternatives first occurs. The acceptance period begins on the day after the Customer sends the offer and ends at the close of the fifth day following the offer’s submission. If the Seller does not accept the Customer's offer within the specified period, this is considered a rejection of the offer, resulting in the Customer no longer being bound by their declaration of intent.
2.4 For payments made via PayPal, payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., under the terms of use available at https://www.paypal.com. If the Customer selects a PayPal payment option, the Seller accepts the Customer’s offer at the time the Customer clicks the button that completes the order process.
2.5 When placing an order through the Seller's online order form, the contract text is stored by the Seller and sent to the Customer in text form (e.g., email, fax, or letter) after the Customer has submitted their order. A further provision of the contract text by the Seller does not occur.
2.6 Before a binding order submission, the Customer can identify potential input errors by carefully reviewing the information displayed on the screen. A helpful technical tool for recognizing input errors can be the browser's zoom function, which enlarges the display on the screen. The Customer can correct their entries during the electronic ordering process until they click the button that concludes the ordering process.
2.7 The contract can be concluded in German and English.
2.8 Order processing and contact usually take place via email and automated order processing. The Customer must ensure that the email address they have provided for order processing is accurate to receive emails sent by the Seller. Especially if using SPAM filters, the Customer should ensure that emails sent by the Seller or third parties involved in the order process can be received.

**3) Right of Withdrawal**
3.1 Consumers generally have a statutory right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the Seller's withdrawal policy.
3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, do not belong to a member state of the European Union and whose sole place of residence and delivery address are located outside the European Union.

**4) Prices and Payment Conditions**
4.1 Unless otherwise stated in the Seller's product description, the prices quoted are total prices, including statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description.
4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases that the Seller is not responsible for, and which must be borne by the Customer. These include costs for money transfer by credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties). Such costs may also be incurred for money transfers if the delivery is not to a country outside the European Union but the Customer makes the payment from a country outside the European Union.
4.3 The available payment methods are communicated to the Customer in the Seller's online shop.
4.4 Payment processing for credit card payments via Stripe is handled by Stripe Payments Europe Ltd.

**5) Delivery and Shipping Conditions**
5.1 If the Seller offers shipping, delivery will be made to the delivery address provided by the Customer within the specified delivery area, unless otherwise agreed. The delivery address specified in the Seller's order processing is decisive for the transaction.
5.2 If delivery of the goods fails for reasons for which the Customer is responsible, the Customer bears the reasonable costs incurred by the Seller. This does not apply regarding the costs for the original shipment if the Customer exercises their right of withdrawal. For return shipping costs, the provisions of the Seller's withdrawal policy apply.
5.3 If the Customer is an entrepreneur, the risk of accidental loss and accidental deterioration of the goods passes to the Customer once the Seller has delivered the item to the shipping company, carrier, or person responsible for shipment. If the Customer is a consumer, the risk of accidental loss and accidental deterioration of the sold item generally transfers upon delivery of the item to the Customer or an authorized recipient. However, if the Customer independently commissions a carrier not specified by the Seller, the risk transfers upon delivery to that carrier.
5.4 The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-supply. This applies only if the Seller is not responsible for the non-delivery and has concluded a matching cover transaction with the supplier with due diligence. The Seller will make all reasonable efforts to procure the goods. In the event of non-availability or partial availability of the goods, the Customer will be informed without delay, and any consideration will be promptly refunded.
5.5 If the Seller offers collection of the goods, the Customer can collect the ordered goods during the business hours specified by the Seller at the address specified by the Seller. In this case, no shipping costs are charged.
5.6 Vouchers are provided to the Customer as follows:

**6) Retention of Title**
If the Seller provides advance payment, they retain ownership of the delivered goods until full payment of the purchase price owed.

**7) Liability for Defects (Warranty)**
7.1 Unless otherwise specified, the statutory provisions on liability for defects apply. Deviating from this:
- For new goods, the limitation period for defects is one year from delivery of the goods for entrepreneurs.
- Rights and claims for defects are excluded for used goods for entrepreneurs.
- The limitation period does not start anew if a replacement is provided within the scope of the liability for defects.
7.2 For entrepreneurs, the statutory limitations apply for any recourse claims according to law.
7.3 The above limitations and reductions of time limits do not apply to:
- Claims for damages and reimbursement of expenses by the Customer,
- Cases where the Seller fraudulently concealed the defect,
- Goods that have been used for a structure following their usual use and caused its defectiveness,
- For any obligation of the Seller to provide updates for digital products, in contracts for goods with digital elements.

**8) Special Conditions for Processing Goods According to Customer Specifications**
8.1 If the contract includes the processing of goods per specific Customer instructions, the Customer must provide all required content (e.g., texts, images, or graphics) in the formats specified by the Seller. The Customer is solely responsible for obtaining rights to these contents. The Customer ensures that no third-party rights, especially copyrights, trademarks, or personality rights, are violated by providing the contents.
8.2 The Customer indemnifies the Seller from any third-party claims based on violations of rights in connection with using the Customer's content by the Seller. The Customer shall cover the necessary legal defense costs, including all court and attorney's fees.
8.3 The Seller reserves the right to reject processing orders if the provided content violates laws or goes against public morals, especially in cases of hate speech, discriminatory or offensive content.

**9) Special Conditions for Repair Services**
If the Seller owes repair services per the contract, the following applies:
9.1 Repair services are provided at the Seller’s location.
9.2 The Seller provides services either personally or through qualified personnel. The Customer has no right to select specific personnel unless stated in the service description.
9.
3 The Customer is obligated to provide all necessary information for the repair and bear the shipping costs.
9.4 The Customer is also responsible for transport costs for returning items, and risk transfers upon dispatch.

**10) Redemption of Promotional Vouchers**
10.1 Promotional vouchers issued free of charge are redeemable only in the Seller's online shop and within the specified timeframe.
10.2 Promotional vouchers may exclude specific products as indicated.
10.3 Promotional vouchers can only be redeemed before concluding the order process and are non-refundable.
10.4 Multiple promotional vouchers may be used per order.

**11) Redemption of Gift Vouchers**
11.1 Gift vouchers are redeemable in the Seller’s online shop, with an expiration date three years after the year of purchase.
11.2 Each order can only include one gift voucher.

**12) Applicable Law**
12.1 The law of the Federal Republic of Germany applies, excluding the CISG. This does not affect consumer rights under mandatory regulations of the consumer’s residence country.
12.2 This choice of law does not apply to consumers outside the EU.

**13) Alternative Dispute Resolution**
13.1 The EU Commission provides an online dispute resolution platform accessible at https://ec.europa.eu/consumers/odr.
13.2 The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
